ACKNOWLEDGMENT AND ACCEPTANCE OF THIS AGREEMENT:
The Services, provided by Braille School, is provided to you, the user, under the terms and conditions of this Agreement, and any amendments thereto, and any operating rules or policies that may be published from time to time by Braille School, all of which are hereby incorporated by reference. This Agreement comprises the entire agreement between you, the user, and Braille School and supersedes any prior agreements pertaining to the subject matter contained herein.

USER'S REGISTRATION OBLIGATIONS:
If any information provided by you, the user, is untrue, inaccurate, not current, or incomplete, Braille School has the right to terminate your account and refuse any and all current or future use of the Services offered by Braille School.

Your e-mail address must be current on your account and at the time of registering for such account. The reason being is that the system can only send your login information to you via e-mail should you ever forget it in the future.

MEMBER CONDUCT:
As a condition of your use of the Service, you warrant to our service that you will not use the Service for any purpose that is unlawful or prohibited by these terms, conditions, and notices.

The Service is provided to individuals only and for personal use only. Any unauthorized commercial use of the Service, or the resale of its services, is expressly prohibited.

You agree to abide by all applicable local, state, national and international laws and regulations and are solely responsible for all acts or omissions that occur under your account or password. By way of example, and not as a limitation, you agree not to:

Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.

Publish, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful material or information.

Harvest or otherwise collect information about others, including email addresses, without their consent.

Interfere with or disrupt networks connected to the Service or violate the regulations, policies or procedures of such networks.

Attempt to gain unauthorized access to the Service, other accounts, computer systems or networks connected to the Service, through password mining or any other means.

Interfere with another member's use and enjoyment of the Service or another individual's or entity's use and enjoyment of similar services.

Our service has no obligation to monitor the Service or any user's use thereof or retain the content of any user session. However, our service reserves the right at all times to monitor, review, retain and/or disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request.

GENERAL PRACTICES REGARDING USAGE AND STORAGE:
You acknowledge that Braille School may establish general practices and limits concerning use of the Service, including without limitation the maximum number of messages that may be sent from an account on the Service and the maximum number of times (and the maximum duration for which) you may access the Service, in a given period of time. You agree that Braille School has no responsibility or liability for the deletion or failure to store any messages and other communications maintained or transmitted by the Service. You further acknowledge that Braille School reserves the right to change these general practices and limits at any time, in our sole discretion, with or without notice.

PROPRIETARY RIGHTS:
You acknowledge that content, including, but not limited to text, software, music, sound, photographs, video, graphics or other material contained in sponsor advertisements or information presented to you through the Service or advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws.

PRINTING OF THE BRAILLE SCHOOL WEBPAGES:
Printing of any pages located within the Braille School websites, including but not limited to the tutorial pages, is strictly forbidden without the express written consent of an authorized representative of Blindness Related Learning (also known as Braille School.)

CAN I VIEW, COPY, OR BUY YOUR SOURCE CODE AND SCRIPTS:
In short, we have worked very hard over the years to get this website and its services to where it is right now. All code on this domain is copyright to Blindness Related Learning. Therefore, our scripts and source code will never be available for viewing, copying, making other works from, or for sale.

DISCLAIMERS/LIMITATION OF LIABILITY:
The information and services included in or available through the Service may include inaccuracies or typographical errors. Changes are periodically added to the information herein. OUR SERVICE and/or its respective suppliers may make improvements and/or changes in the Service at any time.

OUR SERVICE does not represent or warrant that the Service will be uninterrupted or error free, that defects will be corrected, or that the Service or the server that makes it available, are free of viruses or other harmful components. OUR SERVICE does not warrant or represent that the use or the results of the use of the Service or the materials made available as part of the Service will be correct, accurate, timely, or otherwise reliable.

You specifically agree that OUR SERVICE is not responsible or liable for any threatening, defamatory, obscene, offensive or illegal content or conduct of any other party or any infringement of another's rights, including intellectual property rights. You specifically agree that OUR SERVICE is not responsible for any content sent using and/or included in the Service by any third party.

OUR SERVICE AND/OR ITS RESPECTIVE SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE SERVICE FOR ANY PURPOSE. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SERVICE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SERVICE AND ITS RELATED WEB SITES.

INDEMNIFICATION:
You agree to indemnify and hold OUR SERVICE, its parents, subsidiaries, affiliates, officers and employees, harmless from any claim, demand, or damage, including reasonable attorneys' fees, asserted by any third party due to or arising out of your use of or conduct on the Service.

MEMBER ACCOUNT, PASSWORD, AND SECURITY:
If a particular Braille School Site/Service requires you to open an account, you must complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form. You then will choose a password and a user name. You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify Braille School immediately of any unauthorized use of your account or any other breach of security. Braille School will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by Braille School or another party due to someone else using your account or password. You may not use anyone else's account at any time, without the permission of the account holder.

TERMINATION/ACCESS RESTRICTION:
Braille School reserves the right, in its sole discretion, to terminate your access to any or all Braille School Sites/Services and the related services or any portion thereof at any time, without notice.

Braille School may also terminate or suspend your access to Braille School Site/Service(s) for inactivity, which is defined as failing to log into a particular service for an extended period of time, as determined by Braille School or for any information within your account that is determined to be inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful. Upon termination of the Braille School Site/Service, your right to use the Braille School Site/Service immediately ceases.

DUPLICATE ACCOUNTS:
Duplicate accounts are not permitted on the Braille School websites. If duplicate accounts are found, an email will be sent to all of the email addresses that were used to register the accounts to request that the account holder choose an account. If a response is not received within seven days of the email being sent, all accounts may be terminated without notice to the account holder.

FALSE EMAIL ADDRESSES:
The email addresses that are used to register for an account must be true and active. The reason for this is because your account information can only be sent to your email address from the "forgot login information" form. If your email address is incorrect, you will be sent a message to your accounts inbox, and your account will get a warn number of one. Once your warn number reaches three, your account will be terminated and will be added to the violations database which will then prevent the account holder, or anyone in the public domain from registering for that username.

DATA PROTECTION:
Braille School is required by law to keep all information on its members private unless permission is given by the member, unless otherwise requested by law to hand over such information.

Braille School will not, at any time, sell or share information about its members to anyone, including any third party outside Braille School.

GENERAL TERMS:
These Terms of Service will be governed by and construed in accordance with the laws of the State of New York, without giving effect to its conflict of laws provisions or your actual state or country of residence. Both you and Braille School submit to personal jurisdiction in New York. If any provision of the Terms of Service is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Braille School's failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. The section titles in the Terms of Service are for convenience only and have no legal or contractual effect.
